ESTATE PLANNING

Our attorneys are familiar with the use of the sophisticated estate planning “tools” which may be appropriate, including wills, trusts (whether lifetime or testamentary), family partnerships or LLCs, life insurance trusts, grantor retained annuity trusts or unitrusts, charitable remainder trusts, and charitable lead trusts.
PROBATE
Probate is the process by which a Court determines if a Last Will and Testament is valid. If you do not have a Will, state law will determine who will receive your assets at your death. In Georgia, a married person’s assets will be divided between the surviving spouse and any children. An unmarried person’s assets generally will pass to his or her parents or children (or possibly to more distant relatives). In addition, any assets passing to minor children may ultimately be distributable to them at age 18.
